Real estate agents are covered by the"Do Not Call" list. Under most circumstances, we can't even call a FSBO with a yard sign inviting everyone else in the world to call for information.
So why does my cute little Blackberry, with a number that's been on the list since Day One, get calls with peope on the other end doing this?
It rings.
I pick up, although I don't recognize the number. I mean, ya never know!
"Hi, do you have a minute?"
"That depends," I reply, knowing what's probably coming and wanting to sound not too bitchy up front.
"Well, I have some great news! My company can fix your web site so it's the Number One Site of any kind on Google! Would you like that?"
"Well, #@*&!!" I reply, adding, "Oh, and what is the name of your company again? Uh huh. And where are you located?"
Then I explain how there is a simple procedure by which I will file a "formal complaint" with the Feds that will tie the caller's company up in litigation for the rest of the 21st century.
"Oh, and you will also be blog fodder on Active Rain!" I inform them.
So next week, I'm checking out the exact procedure to use. A formal complaint is different than just writing a letter to the Feds, but only with respect to the format. Then the bad guys really do have to hire a gazzillion dollar an hour Washington law firm to defend themselves. It's a royal pain in the butt. And it's one of those handy life skills I picked up in my former life as a Nader's Raider!
So next week, I'll post the exact details on how to do it. By the way, it's actually fun!

You are so right. My favorite is to ask them for their home number or mobile number and then give them hell when they say they don't give that out.
Patricia, when you publish your Blackberry telephone number on your blog, website, office, etc., you automatically exempt the number from the Do Not Call Registry. By publishing your number as a business entity, your telephone number becomes exempt. It will now fall under the category of Business-to-Business calls which are exempt from the Do Not Call Registry. Business-to-Business calls are not in violation of the Telemarketing Sales Rule. One of the down falls of being a real estate agent.

I too hate telemarketing calls. However, it amazes me how salespeople are more adamant about telemarketers than non-salespeople. Something like how ex-smokers are the most adamant about non-smoking. Heck, they are just trying to make a living too.
Hi Pat, I like to cuss them out in Cajun French. They don't have a clue what I say and hang up eventually.
Pat - I will be looking for that post with the details!!! I usually just hang up on them, but your way sounds like so much more fun!!! Then they will stop bothering me and many others as well!!!

Michael, Wow! I had no idea that we were a little exception to the rule! I just may have to file a petition for rulemakeing so they'll have to stop harassing us!
Still, I'll call tomorrow and try to get information on how to file a formal complaint. Ill also try to get instructions for ways to change the rules. One of my clients is a retired legal eagle who does this kind of stuff as a hobby!
Pat - I actually have 2 "regular" sales guys who call me. I have them saved in my phone as "SALES DO NOT ANSWER". You'd THINK they'd get the hint after I said no a couple times and hung up!

I researched the Telemarketing Sales Rule again and it quoted as follows:
Unless a telemarketer is trying to sell you Nonudrable Office or Cleaning Supplies the exemption applies. Hope this help. - Michael Setunsky
